4. Payment

Payment is due at the beginning of each billing cycle and processed via available payment methods supported by our payment providers.

5. Intellectual Property and License Scope

Subject to your ongoing compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services.

You may not copy, modify, distribute, or sell any part of our platform without our prior written consent.

Rights of third-party software (including open-source software) and licensors remain with their respective owners, and all rights not expressly granted are reserved.

6. Limitation of Liability

To the maximum extent permitted by law, we are not liable for direct, indirect, incidental, special, or consequential damages arising out of or related to your use of the platform.

We reserve the right to suspend or terminate your access to the platform at any time, without notice, if you violate these Terms.

Continued use of the platform after changes constitutes acceptance of the updated Terms.

9. Email Communications

We may collect your email address and send product updates, operational notices, and promotions related to Eluvit.

10. Excessive, Exploitative, or Harmful Usage

Eluvit may immediately or temporarily suspend accounts without refunds, or otherwise restrict access, for the following actions:

• Use by multiple users
• Submitting sexually explicit content to the AI
• Attempting to incite violence through AI responses
• Hate, discrimination, harassment, illegal or harmful conduct through the Services
• Misrepresentation, impersonation, spam, malware, or other trust-abusing behavior
• Infringing or misappropriating intellectual property rights of others
• Systematic or automated data collection, including scraping, data mining, extraction, or harvesting
• Misrepresenting the source or context of service-generated content
• Incurring usage costs that exceed 2.5x the monthly subscription fees
• Any activity reasonably deemed outside normal usage by the company

11. Right to Temporarily Suspend Usage

For paid accounts, if abnormal usage creates disproportionate service costs, access may be temporarily restricted under our internal policies.

These safeguards protect service sustainability and fair access for all users. Repeated violations may result in permanent suspension.

12. User Content

You are solely responsible for content you upload, post, transmit, or otherwise make available through the Services.

We do not control all user content and do not guarantee its accuracy, integrity, or quality. You assume the risks of relying on such content.

We may retain, disclose, remove, or restrict access to content when required by law or necessary to enforce these Terms.
